Terms of Service

1. Acceptance of terms

By creating an account or using Real Estate Genie (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for licensed real estate professionals. You represent that you are at least 18 years old and authorized to enter this agreement on behalf of yourself or your organization.

3. Accounts

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.

4. Subscriptions and billing

Paid subscriptions renew automatically until cancelled. You may cancel anytime from the app. Fees are non-refundable except where required by law. Usage-based overage fees are charged in arrears.

5. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party right.
• Share your account or MLS credentials with other agents or brokerages.
• Scrape, resell, or redistribute MLS or property data outside the Service.
• Reverse engineer, disrupt, or interfere with the Service's security or infrastructure.
• Use the Service to send spam, harass, or contact consumers in violation of TCPA, CAN-SPAM, or other communications laws.

6. MLS data

MLS access is licensed per agent. You must have a valid, current license with each MLS you connect. You are solely responsible for compliance with the rules of any MLS or data source. We may suspend MLS access if a licensing issue arises.

7. AI outputs

The Service includes AI-generated outputs (descriptions, reports, comp narratives, etc.). These outputs are provided "as is" and may contain errors. You are responsible for reviewing and verifying any AI-generated content before using it with clients or in marketing.

8. Your data

You retain ownership of the data you input into the Service. You grant us a non-exclusive license to host and process that data as needed to provide the Service. See our Privacy Policy for details.

9. Termination

You may cancel anytime. We may suspend or terminate accounts that violate these Terms or pose a security risk. On termination, your right to access the Service ends, and we may delete your data after a reasonable retention period.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA DISPLAYED IS ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

12. Governing law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Honolulu, Hawaii.

13. Changes

We may update these Terms from time to time. Material changes will be notified through the Service. Continued use after changes constitutes acceptance.
